1. Scope of Services

WebCraftStructure provides web development services including server-side architecture design, custom web software development, API ecosystem construction, database engineering, and cloud deployment. All services are delivered as described in individual Statements of Work (SOW) agreed upon between WebCraftStructure and the Client.

2. Contract Formation

A binding contract is formed upon mutual acceptance of a project proposal or Statement of Work. Project proposals remain valid for 14 calendar days from the date of issuance unless otherwise stated in writing.

3. Payment Terms

Unless otherwise specified in the SOW:

• 50% advance payment is required upon contract signing
• Remaining 50% is due upon project delivery and acceptance
• All invoices are payable within 14 calendar days of issuance
• Late payments incur a statutory interest rate of 9 percentage points above the ECB base rate

4. Intellectual Property Transfer

Upon complete settlement of all agreed commercial invoices, WebCraftStructure assigns all worldwide intellectual property rights in the client-specific software deliverables, design tokens, source code, and digital assets directly to the Client. WebCraftStructure retains the right to use anonymized project methodologies and general technical patterns for internal knowledge development.

5. Client Obligations

The Client agrees to provide timely access to necessary systems, APIs, credentials, and business documentation required for project delivery. Delays in client-provided materials may result in adjusted project timelines communicated in writing.

6. Limitation of Liability

WebCraftStructure's total aggregate liability under any contract shall not exceed the total fees paid by the Client for the specific project giving rise to the claim. WebCraftStructure shall not be liable for indirect, consequential, or incidental damages, including lost profits or data loss beyond the scope of direct project deliverables.

7. Confidentiality

Both parties agree to maintain strict confidentiality regarding proprietary business information, trade secrets, and technical documentation disclosed during the course of the engagement. This obligation survives the termination of the contractual relationship for a period of 3 years.

8. Governing Law & Jurisdiction

These Terms of Service are governed by the laws of the Federal Republic of Germany. Any disputes arising from or in connection with these terms shall be submitted to the exclusive jurisdiction of the competent courts in Offenbach am Main, Germany.

WebCraftStructure uses only essential cookies necessary for the functioning of the platform. We do not use tracking, advertising, or analytics cookies.

3. Managing Cookies

You can control and manage cookies through your browser settings. Disabling essential cookies may affect the functionality of the WebCraftStructure platform. Most browsers allow you to block or delete cookies through their settings menu.

4. Third-Party Services

WebCraftStructure does not integrate third-party tracking or advertising scripts. The embedded Google Maps widget on our contact page may set cookies under Google's own privacy policy when you interact with the map interface.

5. Changes to This Policy

We may update this Cookie Policy from time to time to reflect changes in our practices or for operational, legal, or regulatory reasons. The revised policy will be posted on this page with an updated effective date.

1. Service Level Agreement (SLA)

Clients enrolled in active maintenance retainers benefit from the following guarantees:

• Uptime Guarantee: 99.97% monthly uptime for all hosted infrastructure
• Response Time: Initial response within 2 business hours for standard inquiries
• Urgent Dispatch: On-call architect contact within 30 minutes for critical incidents
• Resolution Window: Critical issues resolved within 4 hours; standard issues within 24 hours

2. SLA Monitoring & Reporting

WebCraftStructure maintains continuous uptime monitoring through automated health checks. Monthly SLA compliance reports are available upon request for clients with active maintenance agreements.

3. SLA Breach Remedies

In the event that WebCraftStructure fails to meet the agreed SLA targets:

• For each hour of downtime exceeding the SLA threshold, the Client receives a service credit equal to 5% of the monthly retainer fee
• Service credits are capped at 30% of the monthly retainer fee
• Credits are applied as deductions on the next invoiced period

4. Refund Policy for One-Time Projects

For project-based engagements (non-retainer):

• Pre-Discovery Cancellation: Full refund of advance payment if cancelled before the Discovery phase begins
• Post-Discovery Cancellation: Refund of the advance payment minus the Discovery phase fee (25% of advance)
• Mid-Development Cancellation: No refund for work completed; any advance payment covers completed milestones
• Post-Delivery Acceptance: No refunds once the Client has accepted and taken delivery of the project deliverables

5. Refund Processing

Approved refunds are processed within 14 business days to the original payment method. The Client will receive written confirmation of the refund amount and processing timeline.

6. Retainer Cancellation

Monthly maintenance retainers may be cancelled with 30 days written notice. No refund is provided for the current billing period in which cancellation is submitted. All SLA obligations cease upon the effective date of cancellation.
